10:30 Kim Wilson, Assessor –
Parcel Corrections and Property Tax Refunds: Water’s Edge, Carson &
Samantha Ellingford.
10:35 Minutes approved.
10:45 LouJean Argyle, Treasurer –
Crawford Mountain Properties 2022 delinquent – will go to the May Tax Sale.
This 42,000 acre property is for mining claims only on State and BLM properties
and has many investors.
11:00 Candy Cornia, Rich County Conservation
District asked for $2,500 for 2023. The money is used for scholarships and a
match for other grants. It was approved.
11:15 Scott & Sharon Heiner
requested a refund that their property management had paid inadvertently. It
was granted.
11:30 Brendan Walker, Lake Effect
Landscaping requested a Business License. It was approved upon payment of the
license fee.
11:45 Dustin & Jodi Goodwin,
requested an application for a building covenant to run with the lot. Mitch
will review this application and find out what the responsibility if any is for
the county to decide.
12:00 Mitch Poulsen, Bear Lake
Regional Director gave direction to the Commissioners on how the County should
not have to do any of the building covenants. It is up to the homeowner to
contact the HOA and explain what their plans would be. If there are no public
easements that need to be reviewed then it is up to the HOA to decide what the
next steps would be. That would include contacting the neighbors within a 300’
radius of the property.
Mitch also asked for a match of $25,000
for the Bike Path and a letter from the Commissioners for the grant
application. The grant is about $600,000 and will be supported by Outdoor Utah.
1:30 Bryce Nielson, Emergency
Management Services Director – discussed the Special Needs Resolution that is
available to each person in the County who might need help in an emergency situation.
He also discussed the Spring
Run-off Plan.
1:45 Randall Knight, presented the
name of Rich Schaefer as a Garden city Fire District Board Member. Approved.
1:50 Dave Enns for Rich county
Sanitation presented the information on the needed trucks and track hoe to
maintain the County dump.
2:00 Ben Willougby, County Attorney
led the discussion of the Rich County Adjoining Landowners Ordinance Pertaining
to the Construction and Maintenance of Fences in Rich /count for Agricultural
Purpose, for Provisions for Payment by Adjoining Landowners and for the
Provision for non-payment.
He talked about the reasoning for
Business Licenses and the charges. General contractors do not need another
business license if they have one from another entity in the State. Food Trucks
also may use their license from another entity. Some businesses are exempt –
like Day Care Centers as they are licensed by the State. But if there are
problems then that is when the County steps in.
There will be a public hearing in April to try to explain the whys and
wherefores.
Next he talked about the
fence-in/fence out general policy in Rich County (this will be on a public
hearing in April). There is much to think about as Utah is an open range area
except in towns and people are responsible if they kill a cow.
A discussion was held on the Rich
County Aging Council. Bill suggested the Council hold off until the Legislature
defines what the State wants counties to do.
3:30 Commission Business –
Discussion on Collecting Sales Tax on the Short term Rentals. Some of the Big
companies collect the sales tax and some do not.
3:40 Motion was made to appoint
the new Rich County Chairman. Sim Weston was appointed.
