Short-term Rental Discussion approved 7 units.

Public Hearing to discuss the Ordinance 23-28 to
update water usage for 2024 (some
secondary home owners feel that they are over charged because they only use the
water for 6 months or less and some feel frustrated because they live outside
of the town limits and are charged more for service. One of the solutions would be for those out of
town limits would be to be annexed in to the City. This would help them as the
extra $30.00 in water charges would more than pay for the City Tax. Another
help would be the opportunity for those who live outside of the Town limits to
vote or hold office taking the pressure off our local folks who volunteer for
so much. A last problem, in order to be a fully qualified library, we need 1,500
people who live within the limits of Garden City). And lastly it would
be interesting to know the cost of the blowout of the water line by the Marina
which affected everyone north of the intersection.
Ordinance 23-31 adds a sprinkler system to
the water ordinance;
Resolution R23-08 to Adjust the 2023-2024
Budget;
Creating a Public Infrastructure Dist.
(PID) for Bear Lake Vista.
Public Hearing closed.
7.
PID for Blue Vista discussed and the Governing
Documents need to reflect the City’s required points. (return next month).

Resolution to Adjust the Budget was passed.
Resolutions for establishing a fine for damage to underground Utilities, fines
for improper maintenance of a water line supplying a fire suppression, and a
resolution to establish a fine for flying closer than 1,000 feet without a
permit will all be discussed in January.
9.
Ordinance 23-32 regarding egresses and ingresses
in subdivisions just had minor word changes; ordinance 23-03 considering commercial
setbacks discussed. No action;
an ordinance to establish water rates and
water overage use for 2024 will be $52.00 for households of 15,000 gallons per
month, empty lots are charged $10.00 per month, overage costs are $2.00 for the
first 3,000 gallons over, $4.00 for the next 3,000 gallons (now I could have
the figures wrong-you can check with the office for the correct amounts). Approved.
Ordinance 23-29 updating roadway and
cul-de-sac definitions.
Ordinance 23-30 updating computation of off
street parking spaces. Approved.
Ordinance 23-31 adding the wording for
sprinkler systems to the water ordinance. Approved.

Board Appointments for discussion/approval:
a.
Library Board-Michele Thompson and Linda Baird
will be appointed.
11.
Misc. review the work by the BYU-I committee for
rebranding next month.
TRT monies have been awarded. $102,000 for
the Splash pad at Heritage Park, $19,000 to help with short term rental
requirements, $25,000 for sidewalk around Pickleball Courts at Heritage Park,
and $200,000 for lights at new ball field.
Obituary-Gerald Eugene Phelps
Gerald (Jerry) Eugene Phelps completed his journey here on earth December 16, 2023, just shy of his 97th birthday. He was born to Willmer and Minnie (Larsen) Phelps on February 3, 1927 in Montpelier, Idaho. He is survived by his younger brother Richard and preceded in death by his older brother Lloyd.
Jerry graduated from Montpelier High School in 1945 and almost immediately was inducted into the Army and stationed in Fort McPherson, Georgia. After being honorably discharged at the rank of corporal in 1947 he married a Georgia girl, Mildred (Millie) Bragg and brought her home to Bear Lake.
Jerry and Millie were married 77 years and had two children, Sherry (spouse Dave) Shelton and Stephen (spouse Lanitta) Phelps. They had six grandchildren, Kimberly (spouse Jim) Tippetts, Chris (spouse Christy) Phelps, Brandi (spouse Bryan) Henrie, Ben (spouse DanaLee) Phelps, Ryan Shelton and Robert Shelton. There are 19 great grandkids and 7 great, great grandkids.
Jerry had a full and diverse life. He began his working career working at the grain mill in Montpelier but soon became part owner at a local grocery store. One day a customer told him of an opportunity to manage his own Chevron service station which he did from 1952 to 1974. He then owned and operated a tire store, trailer and snowmobile sales from 1966 to 2004. He even did a little farming on the side at a place he had in Fish Haven Canyon.
Among other things he and his wife owned and operated the Sunset Motel. He was Chairman of the Board of Directors for Tri-State Bank for several years until it was purchased by Zions Bank. He was a member of the Jaycees, Lions Club, Rotary Club and a founding member of Bear Lake Watch.
With his wife he traveled Europe, China, Africa, Canada, Mexico, New Zealand and all over the United States. There were cruises with family and friends and fishing, hunting, skiing and snowmobiling.
He loved living on the lake shore in Garden City, Utah and spent many hours recreating and enjoying the beauty of Bear Lake. He most enjoyed having his grandkids come to visit.
Jerry left a legacy of a life well-lived and a man well-loved by his family and friends.

The funeral can be viewed any time after the service as well at the same place.

Rich County commission Dec. 13, 2023
10:00 Brandon Rowe from the Rich County Road Dept. presented
the bids for the new road grader. Approved. The County will pay $150,000 down
and finance the last $300,000.
10:15 Richard Droesbeck, Bear Lake State Parks
Superintendent, summarized the 2023 report for the Bear Lake Parks. The Marina
extension is slower than anticipated, but hopefully the project will start by September 2024. Offsite construction materials
will be stored on the upper parking beginning in May. Personnel grubbed 150
acres of sagebrush at Rainbow Cove. Rendezvous has updated their pump house. 1st
Point has culvert problems due to run off. The parks set up 3 tiny homes at
Rendezvous for seasonals. The ramps need to be redone. Estimated cost is
$175,000. They will wait until the water goes down. The Trout Unlimited plan is
waiting on final approval from the Corp. of Engineers.
Fire Warden, Travis Hobbs, reported on the lighter than
usual fire season. His assistant, Rick Larsen, will need a 6 month replacement
for the summer and fall. Travis will be updating the Cooperative Wildfire
System for the County and the Community Wildfire plan will be reviewed in 2024.
Much discussion was held about the road up Swan Creek and what to do about
access to help homes in that area in case of fire.
Several property tax issues were discussed and solved.
Mitch Poulsen from the County Planning & Zoning suggested that the County
raise their fire inspection fees this year for Short Term Rentals.
The Advisory Board of Economic Development needed to replace
members whose terms were up this month. Kam Jarman and Jordan Parry were
appointed to 4 year terms. The County rep will be Sim Weston, the city rep will
be represented by Jordan, Nikki Weston and Erick Wamsley represents the
communities of Rich County. The grants given this year will have more tracking
done on how the grant affected new jobs, or upgrades on the businesses
receiving them.
The starting wages for the County will be $18 for 2024.
The 2023 budget for the County was approved. Some of the
items were: Select Health increased their rate by 14%; and Rich County will
continue to fund their portion of State retirement at 100%.
