3. A.Business License Discussion & Approval ?

4. a. Request to Rezone Clear Water Subdivision from a C3 to a C1 zone. Matt Larsen and Altair Capital LLC.

    b. Request Approval to Rezone Bear lake RV Resort to a PUD and approval of Conceptual Plan. Sun        Communities Acquisitions LLC.

Questions about how long it takes to pull in to the Resort. Answer: Most of check-ins are done on line. What is the length of stays? Answer:  4-7 days. There will be 4 check in lanes of 500 feet.

Question: In the study are the words vehicles based on cars or truck and trailers? David Alger is the UDOT contact for this project. The RV sites are back in sites. There are 360 back in sites. 20% of Park Models are planned.

Question: How many employees might there be? Answer: maybe 100 in peak season?

Question: Is there onsite housing? Answer: No, still looking for a site for housing.  Suggestion: Perhaps there could be work camper hosts like at KOA. Martel questioned some of the sections of PUD’s. Both sections enable mixed use developments. PUD’s accentuate Lodging, food component, main street store fronts, coffee, burritos, hats & t-shirts, picnic baskets prepared for guests. Martel asked about public amenities. Answer: Sun Communities will offer day passes for locals for pools and sports courts.

What are the guarantees for these questions? Answer: These will be on the plat. Ken Hansen discussed the large vehicle parking. The group has reviewed the large vehicle parking area in revised plans. They will have regulations. Guests will have a 40’ X 70’ lot. Ken also asked if they have planned to work with Paradise Parkway plans. They are willing to meet with anyone or a committee.

Question: Will razors be allowed in the park? Answer: No, they are looking more towards golf carts. Would the guests have to trailer up to the parking area up Hodges Canyon or the Forest? Answer: Yes.  Mayor Mike said that Paradise Parkway needs to be fully built out instead of just the parts adjoining Sun Community.

Will funding be available in the next 12 months for Paradise Parkway? Mayor Mike said yes. The grants are being worked on. If the City goes ahead with the rezone then the City is giving up 300 feet by 800 feet of Commercial Property plans along SR 30. Pat reminded the Resort that they need to be very aware of employee housing as it is a major problem.

Question: Will you sell any park models? Especially for winter use? Not in the foreseeable future. Mike asked it there could be a rental for the season. The resort said yes. Motion by Martel to deny the PUD. Motion died due to lack of a second. Ken made the motion to accept the PUD overlay and approve the conceptual plan. Pat seconded the motion. Motion passed.

a. Preliminary approval for Phase 5 Waterdance. Rezoned as a PUD so no commercial on 3rd West. Motion approved.

b. Request for approval on final plat of Phase 7 of the PUD-Water’s Edge Resort at 35 E. 150 S. Storm water situation has been approved. All Units are ADA accessible. Elevators, showers, and doorways are accessible. Question asked how many employees are planned to support the resort? Future Planning for housing. Time frame build out for Hotel & amenities 18 months. Spring of 2024. Some employees are at the Lodge. Motion passed to approve the final plat of Phase 7 at Water’s Edge.

a. Request for final approval for Phase 2 at the Villages, Kent Fisher. Reviewed the length of the driveways are 27.5 feet. Changed the locations of the dumpsters. Planned for extra parking spaces. The roads will be 26 feet. The water shares will be turned over to the City. Need CC&R’s for phase 2. They have been recorded. According to the City Lawyer they need a current title search. The property was originally owned by Spiers. Lot owners are current in their taxes. The homes allow for Short Term Rentals. There is a County Road from the Pickleville Store to Kimball Road. Motion to approve Light House phase 2.

7. Public Comments: Several comments about the Council not doing things in order or according to the law. They were referred to the city lawyer.

8. 12 Short Term Rentals a-L approved.

a. Ord. 22-04 Change from 9 foot to 10’ by 24’ and parallel parking from    to. Approved.

b. Ord. 22-05 Change STR Parking Requirements 10’ by ?

c. Ord. 22-06 adding Items to final plat by adding addresses to the mylar. Make an addendum on the side. Our code said that we had to have it on the mylar. This was confusing and the group will check it out with the County.

d. Ord. 22-09 Changing Commercial set-backs. 5’ to allow foot travel on the sides if not it should be 20’. Burger Barn wants 0’ set-backs. He is doing an awning where people can order. Blue Water Clothing was allowed to do this. Back to the P & Z for reconsideration.

11. Public Entity Resolution-new account signatures for new council members according to the state law.

12. Miscellaneous: The Schedule for water usage is inequitable and arbitrary. Ken said that he would like to see it done in a fair way.  Residential use is 4.5 outdoor use is using ¼ of your lot and some use zero scape. Put the discussion on the future plans. Bring in a water share per lot or the equivalent and an impact fee. A water share is $12,500. You don’t have to bring in a water share for every home, but several homes may come per share. Swan Creek has 11,000 feet of water. Question:  can you share your water share with any place? Garden City has an agreement with Swan Creek for their water storage. Canal information is a little different. They have to transfer at point of diversion of the canals.

Martell wanted to talk about STR with an idea for Affordable Housing. Much discussion was held about this. The City talked about whose responsibility is this. Is it government or people with property? Could there be a fee on STR that the government could purchase the property and it would then be purchased by the homeowner?

Discussion about a road next to the Pickleville Store. Dustin Hansen owns the store. He wants to build employee housing. Or are there other possibilities?
