Storage Sheds Permits Given

GARDEN CITY, Utah.  December 6, 2017.  A brief discussion ensued among the Commission Members.  Approval of a motion that was made accepted Ordinance #17-17.  This ordinance is adding storage sheds on a Conditional Use Permit in the C-3 Zone.

The Council felt that some rewording was needed on Ordinance #17-18.  The Ordinance changes the term accessory building to accessory structure in the definitions section of the ordinance book.   The Commission members asked that this item be put on next month’s agenda.  Joe Stocking volunteered to try and do rewording to make this ordinance easier to understand.

Rod Stewart was asked to move up to the table to talk with the Commission members about building storage sheds on the western side of the property.  He noted that the property is in the process of being split.  Also, UDOT needs to give approval for the entrance/exit to this property.

The Commission gave the Conditional Use Permit to Stewart.   He was told that everything must be at least 300 feet from the Logan Highway.  Stewart agreed to that requirement.  He also noted that he had personally talked with the Moldenhauers to see if they were concerned about being next to a group of storage sheds and they said it wouldn’t be a problem.

Stewart said that he would create a berm covered with shrubs and trees outside the fence that will surround the storage sheds and add to the appearance of this area.  The City has an ordinance that requires structures to follow architectural standards.  The Commission decided that any buildings that face south would need to follow these standards.

The motion was made to grant the Conditional Use Permit noting that any building facing south will need to follow the architectural standards.  The berm with landscaping shrubs and trees will be used to hide the units from Highway 89.  The Permit will also be conditional upon the lot split that is currently underway.


Rich Layton bought a group of storage sheds along Third West.  He brought two other small pieces of land that are right next to the storage sheds.  He wants to use these two parcels of land for outdoor storage.  These two parcels of land, however, are adjacent to Third West.  When that area was originally zoned, the decision was made that C1 would extend 300 feet from the street.  Land further away than 300 feet was zoned C2 and/or C3.  However, the Commission didn’t know the exact zoning in that area.  They didn’t have a recent map and an older one showed different zoning on the two parcels.  The Commission asked that Mr. Layton check his land tax papers.  The current zoning should be printed on those documents.  They asked that he come back next month when updated information would be available.
