voted on at the Laketown Council Meeting on July 1, 2020 at 7:00 at the Laketown City Office.

AN ORDINANCE OF LAKETOWN AMENDING
THE ZONING REGULATIONS OF LAKETOWN CODE TITLE 10 CHAPTER 6 ARTICLE A SECTION 7
NIGHTLY RENTALS PROHIBITED BY ADDING INCLUDING BED AND BREAKFASTS AND AIR
B&BS, MULTI-OWNERSHIP PROPERTIES SUCH AS LLCS, PARTNERSHIPS, AND TIME
SHARES AND ANY ADDITIONAL MULTI-OWNERSHIPS NOT STATED.
WHEREAS; The Town is committed to
provide for the health, safety, morals, convenience, order, prosperity and
welfare, of the present and future residents, and WHEREAS; The Town has zoning
regulations, and WHEREAS; the Town Council desires to act on the consensus of
the majority of the town residents to protect the Residential-Agricultural
Zones and town residents living in these zones from nuisances associated with
short-term rentals,
WHEREAS; The amendment adding
including Bed and Breakfasts and Air B&Bs, multi-ownership properties such
as LLCs, Partnerships, and time shares and any additional multi-ownerships not
stated is consistent with the purpose of this regulation, and WHEREAS; The
Laketown Planning and Zoning Commission recommends this amendment and the Town
Council conducted a public hearing on the amendment.
NOW THEREFORE, BE IT ORDAINED by
the Laketown Town Council that the Laketown Code Zoning regulations 10-6A-7 Nightly Rentals Prohibited
be amended to add including Bed and Breakfasts and Air B&Bs,
multi-ownership properties such as LLCs, Partnerships, and time shares and any
additional multi-ownerships not stated.
SECTION 1: Language to be added.
10-6A-7 NIGHTLY RENTALS
PROHIBITED: The term “nightly rental’ shall mean the rental of a dwelling unit
or a portion thereof, including a lockout unit for less than thirty (30) days
to a single person or persons. Nightly rental does not include the use of a dwelling
for commercial uses in commercial zones. Nightly rental will not be permitted in
Laketown residential or residential-agricultural zones (Ord. 2009-02,
5-14-2009) including Bed and Breakfasts and Air B&Bs, multi-ownership
properties such as LLCs, Partnerships, and time shares and any additional
multi-ownerships not stated.

I thought Laketown already had a complete ban on rentals to families (short term). Maybe this is just extending things to bed and breakfast too?
Does this disqualify the town of Laketown from Transient Room Tax money? It wouldn't seem fair if they did.
I hope they have a large budget to defend this in court. AirBnB has been know to financially support homeowners that sue.
Kinda surprising that Laketown doesn't actually support private property rights along with the free market./s The progressives would be proud. Hurray for big government!
